The New York Court of Appeals ruled on June 27, 2007 that the New York pre-existing
condition statute (Insurance Law Section 3234) permits a benefit waiting periodof up to 12 months
and not an exclusion of the pre-existing condition for disability policies issued in New York.
As a result of this ruling, Commercial Travelers Insurance Company is automatically undertaking
a re-examination of New York disability claims denied based possibly upon pre-existing conditions
within the period two years prior to June 27, 2007 (the date of the ruling).
Commercial Travelers Insurance will be contacting the affected insureds (if applicable). In the event
